MAMA-PAJAMA'S PLAYHOUSE POLICIES

POLICY: Once an applicant has paid for a Jammie Pal membership, the child(ren) are invited to attend various concerts performed by Mama-Pajama's Playhouse. It is our policy to require all new members to attend a brief informational meeting wherein members will be given more detailed information about the services offered to members. These informational meetings will be held twice a month.

PHOTO AND VIDEO RELEASE: On occasion, Mama-Pajama's Playhouse will take promotional photos and/or videos at various MPP events to be used for print advertising and website inclusion. It is our policy that the names of children and other attendees will NOT be published. Occasionally, it might be necessary to use the first name of a member, but no last names, addresses, and/or telephone numbers will ever be used without written parental consent.

RETURN CHECK POLICY: It is our policy to deposit checks automatically and without notice. A $40 processing fee may be charged for checks returned by the bank for non-sufficient funds (NSF checks). In addition, any subsequent penalties on the returned check will be charged to the writer of the check. When a check is returned, Mama-Pajama's Playhouse reserves the right to require payment by cash, money order, or certified funds.

RENEWAL PROCESS: Memberships are reviewed on an annual basis based on registration date. Members who are up for renewal will be sent a letter with expiring terms and a renewal application form. If the member wishes to continue on as a Jammie Pal member, the parent will need to fill out the renewal application form and attach a check with the appropriate renewal fee, then mail it to the address stated at the bottom of the form for Mama-Pajama's Playhouse. If the member would like to withdraw their Jammie Pal membership, simple send an email to registration@mama-pajama.com stating your intention to discontinue membership. Please be sure to state the Member ID Number, parent name as well as each child's name that will be discontinuing.

EARLY WITHDRAWAL: Should a member wish to discontinue as a Jammie Pal member, an exit interview is scheduled with Kim Raabe. A Letter of Appreciation for their participation and statement of early withdrawal will subsequently be mailed to the withdrawing member. No refunds are given for early withdrawal.

ACKNOWLEDGEMENT AND WAIVER/RELEASE

1. ACKNOWLEDGEMENT OF POLICIES AND PROCEDURES. The undersigned acknowledges reading and knowing all of the policies and procedures relating to the activities, facilities and/or equipment and understands that the safe and proper use of the facilities, equipment or participation in the activity is dependent upon carefully following such policies and procedures.

2. RELEASE. The undersigned releases Mama-Pajama's Playhouse, Kim Raabe, Ann Wieder, and any employees and agents of the aforementioned and agrees NOT TO SUE them on account of or in conjunction with any claims, causes of action, injuries, damage, or cost of expenses arising out of the activity, including those based on death, bodily injury or property damage whether or not caused by the negligence or other fault of the parties being released.

3. WAIVER. The undersigned waives the protection afforded by any statute or law in any jurisdiction whose purpose, substance and/or effect is to provide that a general release shall not extend to claims, material or otherwise which the person giving the release does not know of suspect to exist at the time of executing the release. This means, in part, that the undersigned is releasing unknown future claims.

4. INDEMNIFY AND DEFEND. The undersigned agrees to indemnify and defend Mama-Pajama's Playhouse, Kim Raabe, Ann Wieder, and any employees and agents of the aforementioned (hereinafter jointly referred to as "indemnitee") against, and hold them harmless from any and all claims, causes of action, damages, judgments, cost or expenses, including attorney fees which in any way arise from the activity or this agreement and which include but are not limited to damages to or destruction of any property of the indemnitee of any others, injury or death to the undersigned or anyone else or any liability arising from the act or negligent act of the indemnitee, the undersigned or anyone else.

5. PAY. The undersigned agrees to pay for any and all damages to any property or indemnitee caused by the undersigned either negligently, willfully or otherwise.

6. LEGAL FEES. In the event of any controversy, claim or dispute between the parties arising out of or relating to this agreement or the breach hereof or the activity, the prevailing party shall be entitled to recover from the losing party reasonable expenses, attorney fees and costs.

7. REPRESENTATIVES. The undersigned enters into this agreement for him/herself, his/her heirs, assigns and legal representatives.

8. EMERGENCY TREATMENT CONSENT. The undersigned, as a participant in the subject activity, hereby consents to medical treatment in a medical emergency where the undersigned is unable to consent to such treatment.

9. INSURANCE. The undersigned understands that Mama-Pajama's Playhouse does not carry participant insurance.

10. ACKNOWLEDGMENT. The undersigned has read and understands this agreement and realizes it relates to surrendering and releasing valuable legal rights and does so freely and voluntarily.
